Today we’re talking about normal wear and tear, because that will determine whether or not you can keep any of the security deposit to cure damages left by the tenant. We are not attorneys and we cannot provide legal advice, but our experience can help you decide what to do after a tenant moves out of your property.

 

Identifying Normal War

There is a fine line between normal wear and tear and tenant damage. We are able to discern what that difference is based on our decades of experience and the security deposit case law we know. Normal wear and tear includes minor damage; small scuffs, tiny nail holes, and scratches. Worn and slightly stained carpet, broken hinges, and other insignificant damage can also be considered wear and tear. As the owner, you may not appreciate having to paint your property in between every tenant. But, normal wear and tear makes that necessary, and you at least want to touch up the paint. If the problem can be covered with a coat of paint after a year or more of occupancy, that’s wear and tear.

Move-In Inspections and Damage

Damage is large holes, crayons or marker on the walls, ripped and torn carpet, damage done by pets, and any furniture, personal items, and garbage left behind in the home. We must mitigate or give credit for the existing condition of the property and the amount of time that the tenant was in the property. So, a move-in inspection is done at the lease signing to note any pre-existing conditions that the tenant may feel might jeopardize their deposit. We also use our marketing photos to document the pre-existing condition of the home. Without a move-in inspection signed by the tenant at the lease signing, you can’t keep a penny for damages. That’s why documenting is essential. It protects the tenant and the deposit, and it also protects the landlord if the tenant does damage the property.
